Property Owners Drainage Responsibility
We have had some pretty good downpours in the neighborhood lately including a night time gulley washer of just shy of 9” that resulted in waterlogged lots and at least one flooded home. It came to our attention that the flooding may be aggravated by drainage ditches that have become clogged over the years. So whose responsibility is it to keep these clear and the water running smoothly? 
We wrote to our Precinct 2 Commissioner to find out the true skivvy. It seems that the county is responsible for the drainage ditches along the road rights-of-way but property owners are responsible for all drainage ditches on private property. The letters are linked below but these are the crucial points:
Drainage on our road right-of-way ditches is maintained by the county. If you see a drainage ditch problem on the public right-of-way you should contact the Precinct 2 office (936-539-7383).
There is no flood control district in Montgomery County to maintain drainage on private property.
It is up to private property owners to maintain drainage easements on their property. Property owners should clear excessive brush or trees in a drainage easement on their property and NEVER dump any debris into the channel.
The Property Owners Association has no authority to enter private property to maintain or inspect drainage easements on private property.
